Once again two of veterns have approached at different levels for getting justice to 2nd Pension leftover optees. Mr Gulshan Khuranna has handed over personally a letter at the office of Mr D K Mittal, whereas Mr Pai has in a strongly worded letters asked IBA to reply to his letters and letters forwarded by GoI. We are placing both the letters below for the benefit of our readers. BY HAND IMPORTANT MATTER MUST READ

UNLAWFUL DENIAL OF 2nd OPTION TO JOIN PENSION SCHEME TO BANKOFFICERS WHO VOLUNTARILY RETIRED UNDER OFFICERS’ SERVICE REGULATIONS,1979 Respected Sir, At the outset I express my deep regards and sincere thanks for getting the captioned matter thoroughlyexamined by your Department in a time-bound manner as assured by your good self when I met you last on 22nd May, 2012. It is most satisfying that after due deliberations your office has also concluded that IBA’sinstructions to Member Banks vide their letter No. CIR/HR&IR/G2/665/90/2010-11/999 dated August 10, 2010 were contrary to the approval of the Government so far as the offer of 2nd option of pension to retired bank officers was concerned.

As a remedial measure your instructions to IBAvide DO letter No.10/30/7/2010-IR dated 25th July,2012 were, indeed very loud and clear advising them to withdraw the words“on superannuation ” as contained in their Circular dated 10th Aug.,2010 to PSBs but unfortunately IBA has not complied with your instructions so far. Meanwhile, as you may be aware thatin a recent common Judgment dated 30th Aug.,2012 in respect of several Petitions, theHon’ble Karnataka High Court has also vindicated our stand and held that those who took VRS under OSRs,1979 arealso eligible for 2nd option of pension as per the Joint Note dated 27th April,2010.However, despite this landmark Judgment and a follow up DO letter dated 26th Sept.,2012 from your office reiterating your earlier instructions, IBA is yet toissue revised instructions to Banks in this regard. What more legal direction or administrative order is required by IBA, to act is beyond anybody’s imagination? In view of the above circumstances, I earnestly request your immediateinterventionto direct the Chairman,IBA at your personal level to resolve thisissue in a time bound manner as most of the aggrievedOfficers are Senior Citizens (some are even 74 yrs old)who are desperately waiting to avail their legitimate Pension during their lifetimes. We, the affected officers shall always remain indebted to you, Sir.

Dear Sir,
Ref : Arbitrary Denial of one more option for pension to a section of Bank Employees who are/were in employment as on 29/09/1995 caused due to mischief played by officials of Indian Banks Association.
1. My letter dated 30/08/2012 addressed to you appears to be still under your active consideration even after elapse of 2 months. The matter relates to my complaint given to Minister of Finance on 27/04/2012.
2. In the meanwhile I have now been informed by Sri Manishkumar, CPIO in Ministry of Finance, DFS vide his letter No. F 15/149/2012-IR dated 28/09/2012 that my complaint dated 14/05/2012 addressed to President of India has also been forwarded to you by the consultant to Minister of Finance. DFS under the cover of letter No. F10/30/IG/2012-IR dated 17/09/2012 with a specific direction to you to take appropriate action at your end furnish suitable reply to me (the representationist).
3. I am enclosing herewith a copy of above letter F No. 15/149/2012-IR dated 28/09/2012 for your reference. From my experience for the last 2.5 years, I have found that in this country, Indian Banks Association alone enjoys a privilege of throwing any communication to dustbin received not only from ordinary citizens but also from senior officials of Govt. of India.
4. Now because of specific directions given to you under copy to me by the consultant of Ministry of Finance vide his letter dated 17/09/2012, I hereby demand, as a matter of respect to the senior officials of Govt. of India, a suitable reply from you to my representation dated 14/05/2012 addressed to President of India and my letter dated 27/04/2012 addressed to Minister of Finance. I also wish to know what action has been taken by IBA on the letter dated 26/09/2012 addressed to them by Department of Financial Services, Ministry of Finance. I am unable to wait for your reply for months together due to my poor health. I hereby wish to inform you that I would be at liberty to report back to the present Minister of Finance and to President of India if I do not receive any reply from you before 09/11/2012.
